Smart Mortgage Solutions is a trading name of MortgageTek Limited, which is the data controller responsible for your personal information. We are authorised and regulated by the Financial Conduct Authority (firm reference number 788950) and registered in England (company number 09261635).

What personal data do we collect?

  • Identity and contact details — your name, email address, telephone number and postal address.
  • Financial and employment information — income, day rate or contract details, accounts, bank statements, existing credit commitments and similar information needed to assess affordability and arrange a mortgage or protection product.
  • Special category and credit data — where relevant to advice (for example health information for protection cover, or credit-history information), which we process under additional safeguards.
  • Website and technical data — limited information from your use of this website, such as basic analytics where you have consented (see our cookie policy).

How do we collect it?

Most of the data we hold comes directly from you — through our enquiry form, by email, by phone or in meetings. We may also receive information from third parties such as lenders, credit reference agencies, your accountant or employer, and providers acting on our instructions.

Why do we use it, and our lawful basis

We process your personal data to respond to your enquiry, provide regulated mortgage and protection advice, arrange products with lenders and insurers, and to meet our legal and regulatory obligations. Our lawful bases under UK GDPR are:

  • Performance of a contract — to provide the advice and services you ask us for.
  • Legitimate interests — to operate and improve our service, where this is not overridden by your rights.
  • Consent — for optional activities such as analytics cookies or marketing, which you can withdraw at any time.
  • Legal obligation — to comply with FCA rules, anti-money-laundering law, and tax and record-keeping requirements.

Who do we share it with?

We share your information only as needed to provide our service: with lenders, insurers and product providers; with credit reference and fraud-prevention agencies; and with service providers (such as IT, email and form-handling providers) acting on our instructions under contract. We may also disclose information where required by law or our regulator. We never sell your personal data.

International transfers

Where a provider processes data outside the UK, we take steps to ensure it is protected by an adequate safeguard recognised under UK data protection law (such as an adequacy decision or standard contractual clauses).

How long do we keep it?

We keep your information only for as long as necessary to provide our service and to satisfy our legal, regulatory and tax obligations — which, for regulated mortgage and protection business, is typically a number of years after our relationship ends. Your rights

  • access a copy of the personal data we hold about you;
  • have inaccurate data corrected;
